Welcome to imaxanclimax.com (the “Website” or “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Website, all products and services offered by ImaxAnClimax (referred to as “we,” “us,” “our,” or “ImaxAnClimax”), including custom 3D printed items, laser-engraved products, vinyl items, and related services (collectively, the “Products”).

By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase any Products.

1. Use of the Site

  • You must be at least 18 years old or have parental/guardian consent to use the Site and place orders.
  • You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site.

2. Orders & Custom Products

  • All sales are final for custom-made Products. Because every item is made-to-order and personalized (including custom colors, designs, engravings, dimensions, or client-provided files), we do not accept returns, refunds, or exchanges except in cases of proven manufacturing defect (see Section 6).
  • You are responsible for providing accurate specifications, design files (STL, SVG, etc.), dimensions, colors, text, images, or other materials (“Customer Content”) when placing a custom order.
  • We reserve the right to refuse or cancel any order (even after confirmation) if we believe the Customer Content violates these Terms, infringes third-party rights, or is otherwise inappropriate.
  • Production begins only after payment is received and order details are confirmed. Lead times are estimates only (typically 3–10 business days for production + shipping) and are not guaranteed.

3. Pricing & Payment

  • All prices are in USD and exclude shipping, taxes, and duties (added at checkout).
  • Prices are subject to change without notice; the price displayed at checkout is final for that order.
  • We use SureCart to process payments. You agree to their terms as well (surecart.com/terms).
  • Payment is due in full at the time of order. We accept major credit/debit cards and any other methods offered at checkout.

4. Shipping & Delivery

  • Shipping is via USPS or another carrier at our discretion. Shipping costs are calculated at checkout and are non-refundable.
  • We are not responsible for delays caused by carriers, customs (for international orders), weather, or force majeure events.
  • Risk of loss passes to you upon handover to the carrier. Title passes upon full payment.
  • You must inspect Products immediately upon receipt. Report visible shipping damage to the carrier and to us within 48 hours.

5. Intellectual Property & Customer Content

  • You represent and warrant that any Customer Content you provide does not infringe any third-party copyright, trademark, right of publicity, privacy, or other intellectual property right.
  • By submitting Customer Content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify (as needed for production), and display it solely to fulfill your order.
  • We own all original designs, molds, toolpaths, and manufacturing processes we create unless otherwise agreed in writing.

6. Limited Warranty & Defects

  • We warrant that Products will be free from manufacturing defects in material and workmanship for 30 days from delivery.
  • This warranty does not cover:
    • Normal wear and tear
    • Damage from misuse, accident, abuse, or improper care
    • Color variations (due to monitor settings, filament batch, or natural material differences)
    • Issues arising from Customer Content (poor file quality, incorrect specifications)
  • To make a warranty claim: Contact us at info@imaxanclimax.com with photos and order number within 30 days. If we confirm a defect, we will repair or replace the item at our discretion (shipping costs may apply).
  • EXCEPT AS EXPRESSLY PROVIDED ABOVE, PRODUCTS ARE SOLD “AS IS” WITH NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

To the fullest extent permitted by law, ImaxAnClimax shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or Products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Product giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless ImaxAnClimax, its owners, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms, your Customer Content, or your misuse of the Products.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles. Any dispute arising from these Terms or your purchase shall be resolved exclusively in the state or federal courts located in Carroll County, Maryland. You consent to the personal jurisdiction of those courts.

10. Changes to Terms

We may update these Terms at any time. The updated version will be posted here with a revised “Last Updated” date. Continued use of the Site after changes constitutes acceptance.
